TERMS AND CONDITIONS (PUBLIC OFFER AGREEMENT)

on providing access to the author's online educational course Odesa, Ukraine April 01, 2026 Individual Entrepreneur Stefaniia Amamdjian, here in after referred to as the "Contractor", acting on the basis of the Extract from the Unified State Register of Legal Entities, Physical Persons-Entrepreneurs and Public Formations dated 09.05.2026 No. 2010350000000146722, on the one hand, and any person who concluded this Agreement (hereinafter - the "Agreement") by joining it, here in after referred to as the "Customer", on the other hand, collectively referred to as the "Parties", and each separately as a "Party", have concluded this Agreement as follows:

1. SUBJECT OF THE AGREEMENT

1.1. The Contractor undertakes to provide services by granting access to the author's educational course "Cinematic Portrait. Working with Natural Light" (hereinafter – the "Course") within the meaning of NACE code 74.20 "Photographic activities" (hereinafter – the "Services"), and the Customer undertakes to pay for the Services provided in accordance with the procedure and conditions provided for in this Agreement.

1.2. Intellectual Property Rights:

1.2.1. Under this Agreement, the Contractor grants the Customer the right to limited use of the Course materials (viewing videos and reviewing the PDF supplement) exclusively for personal educational purposes.

1.2.2. Exclusive property rights to video lessons, texts, methods, PDF supplements, and any other materials of the Course belong to the Contractor. Personal non-property rights belong to the Contractor as the author.

1.2.3. The Customer is strictly prohibited from copying, screen recording (screencasting), distributing, transferring login/password to third parties, or any demonstration of Course materials for commercial or public purposes without the written consent of the Contractor.

1.3. The Customer guarantees that they enter into this agreement voluntarily, understanding that the services consist of providing access to digital content on the website https://www.stefaniamamdjian.com.

1.4. This Agreement is an Adhesion Agreement. The Customer joins it by full payment of the Contractor's services.

2. SERVICE PRICE AND PAYMENT PROCEDURE

2.1. The price of the Contractor's services for providing access to the Course under this Agreement is the amount in Ukrainian Hryvnia (UAH) equivalent to 70 (seventy) US dollars 00 cents. In this Agreement, US dollars are used as an accounting unit. Payment is made by the Customer in UAH at the official exchange rate of the NBU on the date of payment.

2.2. Payment under the Agreement is made on the terms of full 100% prepayment through payment systems (Portmone, PayPal, Stripe, or others integrated on the Website) or by bank transfer to the Contractor's details specified in Section 8.

2.3. The Contractor reserves the right to hold promotions and provide discounts, the terms of which are communicated to the Customer on the website.

3. SERVICE PROVISION PROCEDURE: ORDER AND REFUND

3.1. The Customer orders access to the Course through the website https://www.stefaniamamdjian.com.

3.2. Characteristics and the program of the Course (list of modules, video duration, description of the PDF supplement) are indicated on the website.

3.3. Access and Refund Terms:

3.3.1. Access to the Course materials is provided to the Customer automatically or within 24 hours after payment confirmation by providing authorization data (login/password) to the personal account on the Wix platform.

3.3.2. Since the service consists of providing access to intellectual property in digital form, no refund is possible if the Customer has actually gained access to the personal account and viewed more than 1 (one) first educational module or downloaded the PDF supplement (Work Analysis).

3.3.3. This Agreement is not a contract for the purchase of goods. The provisions of Art. 9 of the Law of Ukraine "On Protection of Consumer Rights" regarding the rights of the consumer when purchasing a product of proper quality do not apply to digital content.

3.4. Services under this Agreement are considered properly provided at the moment of sending authorization data to the Customer's email or automatic opening of access on the website.

4. LIABILITY OF THE PARTIES4.1. In case of non-performance or improper performance of obligations, the Parties shall be liable in accordance with the current legislation of Ukraine.

4.2. The Contractor is not responsible for the technical features of the Wix platform, but undertakes to assist in resolving access problems if they arose through the fault of the platform.

4.3. The Customer is liable for each individual violation of intellectual property rights (clauses 1.2.3 and 1.2.4) in the form of a fine in the amount of double the cost of the Course. Violations include: screen recording, transferring access to third parties, publishing the PDF supplement in open sources.

5. CONFIDENTIALITY AND PERSONAL DATA PROTECTION

5.1. The Customer provides full and unconditional consent to the Contractor for the processing of their personal data (name, email, phone number, IP address) for the purpose of fulfilling this Agreement.

5.2. The owner of the personal database is Individual Entrepreneur S. Amamdjian.

5.3. The Parties undertake to maintain the confidentiality of access (login and password) to the Customer's personal account.

6. DISPUTE RESOLUTION

6.1. Disputes arising in the process of fulfilling this Agreement shall be resolved through negotiations.

6.2. If the Parties have not reached an agreement through negotiations within 30 calendar days, the dispute shall be resolved in court according to the current legislation of Ukraine.

7. SPECIAL CONDITIONS

7.1. This Agreement enters into force from the moment of its publication on the Website. The date of conclusion of this Agreement (acceptance of the offer) is the date of full payment by the Customer for the Course.

7.2. The Agreement is valid until the full fulfillment of obligations by the Parties.

7.3. Governing Law: All relations arising from this Agreement are governed by the laws of Ukraine.

Individual Entrepreneur Stefaniia Amamdjian (hereinafter – "Amamdjian S.Zh.") is the owner and author of the educational content hosted on the website https://www.stefaniamamdjian.com. Entrepreneur Amamdjian S.Zh. treats the personal information of all individuals who cooperate with her in any accessible and legal manner with great respect.

Individual Entrepreneur Amamdjian S.Zh. will not sell or transfer personal data to third parties, except as provided by this Policy and the technical necessity of the Wix platform's operation.

I. CONSENT, GUARANTEES, AND USER RIGHTS Guarantees of Protection: The User is guaranteed that: (i) Data is processed exclusively for the purposes defined in this Policy; (ii) The User will be provided with answers to requests regarding their data; (iii) Entrepreneur Amamdjian S.Zh. ensures appropriate technical measures to protect data from unauthorized access or leakage.

User Rights: (i) To know the sources of collection and location of their personal data; (ii) To receive information about the conditions for granting access to data to third parties; (iii) To access their personal data; (iv) To demand the modification or destruction of their personal data if processed unlawfully; (v) To withdraw consent to the processing of personal data.

II. RIGHTS OF ENTREPRENEUR AMAMDJIAN S.ZH. AND PROCESSING FEATURES Definition of the Data Processor: Individual Entrepreneur Amamdjian S.Zh. performs the functions of a data processor. The Customer agrees that for the technical provision of access to the Course, data may be processed by the Wix platform.

Anonymization of Personal Data: Entrepreneur Amamdjian S.Zh. has the right to convert User data into anonymous statistics to improve the content of the website https://www.stefaniamamdjian.com and analyze the quality of the Services provided.
